Introduction

Unlike many of the strong African RTI laws that have been enacted recently, Togo’s 2016 right to information statute has several flaws and is generally subpar. The main weakness in the law is its completely flawed exceptions system, which contains numerous problematic exceptions that have no harm test or workable public interest override. Other concerning features include vague procedures for initial requests and the absence of a mandate governing promotional measures. That being said, the law has a comprehensive scope and a relatively compliant appeals system, though the external administrative oversight body could be strengthened by giving it binding powers and more safeguards ensuring impartiality.
