Introduction

Many of Central Asia’s states have weak RTI laws and Tajikistan is not an exception. While problematic in nearly every category, its most critical flaw lies in its appeals structure. The legislation does not provide the right to appeal either internally through the public authority or externally in the form of an administrative appeal body. This creates major access to justice issues as the only route to reconsider refused requests lies in a judiciary appeal. Other weaknesses of the law include its restrictive scope, lack of a trump provision in its exceptions regime, and non-existent sanctioning or promotional mandates.
