Introduction

Similar to many other Western European states, Switzerland has a relatively weak RTI law. The most substantial issues exist in the problematic exceptions regime, which has exceptions that are beyond international standards and permits exemptions found in other legislation. The exceptions are also neither subject to a harm-test, nor a public interest override. The appeals system is also rather toothless, as there is no provision relating to internal reconsideration and the external administrative oversight body is ineffective, in that its decisions are not binding. In addition to this lack of oversight, there is no system for sanctioning public authorities who routinely fail in their obligations under the legislation.
