Introduction
This is one of many strong RTI laws that have emerged in Africa recently. Its most notable feature is its exemplary scope, which permits all legal persons to request any type of information from each of the three branches of government and other public authorities, including private entities implementing the public functions. Additional features include clear and compliant procedures for both requesting information and appealing refused requests. The law also mandates a relatively strong promotional measures regime. However, the Sierra Leonean law has one major weakness within its exceptions regime. Several exceptions are problematic, as they are either overbroad or illegitimate. Furthermore, the RTI legislation does not have a trump clause to override restrictions on information disclosure in other legislation, such as secrecy acts.Rating updated to reflect the 2022 regulations.

60 | Public authorities are required to report annually on the actions they have taken to implement their disclosure obligations. This includes statistics on requests received and how they were dealt with. | Score Y/N, Y=2 points | 2 | YES | 2 | 41(1) The Commission shall, within three months after the end of the financial year, submit to the Minister a report on the performance of its functions during that year and on its policies and programmes...(4) To enable the Commission to comply with subsection (3), every public authority shall report annually to the Commission on the steps it has taken to implement this Act, including a report on the requests for information it has received and how these have been dealt with. Regulations, 8(1) The annual report referred to under section 41 of the Act shall contain the following information- (a) the number of requests for access received; (b) the number of requests for personal information received; (c) the number of requests for access granted in full; (d) the number of requests for access refused; (e) the number of review applications lodged; (f) the number of cases which as a result of a review access was given; (g) the description of steps taken by the public authority to encourage public information officers and other employees of the public authority to comply with the provisions of the Act, these regulations and other regulations made under the Act; (h) particulars of any penalties imposed against any person; (i) particulars of any disciplinary action taken against any person; (j) particulars of any difficulties encountered in the implementation of the Act, these regulations and other regulations made under the Act; (k) recommendation for reform or amendment of the Act, these regulations and regulations made under the Act. | |
