Introduction

Montenegro has one of the more variable laws worldwide, as its law combines both major strengths with glaring weaknesses. The law’s scope receives a perfect RTI rating and its requesting procedure is above average in terms of comprehensiveness and clarity. Its exemptions regime is also compliant with international standards, each exception being both harm-tested and subject to a public interest override. However, Montenegrin law has major flaws. Notably, the legislation completely omits mention of any independent external review mechanism, such as an administrative body or Ombudsperson. There is also no defined sanctioning system, nor is there a central body with the mandate to promote the right.
