Introduction

Kenya boasts one of many strong RTI laws that have emerged in Africa recently, backed up by very strong constitutional guarantees. Strengths include the laws near-perfect scope, and a strong and independent administrative oversight body with sufficient powers to do its work. There are also strong procedures, albeit no requirement to provide a receipt or waivers for impecunious requesters. Most of the exceptions protect legitimate interests, are harm-tested and are subject to a public interest override, although secrecy laws are preserved. There are also reasonably robust but protections and sanctions, and a fairly comprehensive set of promotional measures.
