Introduction

Vietnam’s law has some strengths but also some notable weaknesses, resulting in a middling score. Its strongest categories are its comprehensive promotional measures and somewhat broad scope, though variable in application to the executive branch. However, the RTI law’s unclear and flawed exceptions regime is a great weakness of the legislation. Many of the exemptions are problematic and while there is something of a public interest override, it is unclear how it functions or whether it could override an exception. Another substantial weakness of the RTI law is that it has an almost non-existent external appeal system. The only available option is an external appeal to the judiciary, which is costly in most cases.
