Introduction

Benin’s law is fairly weak in all areas. The law lacks any promotional measures, making this its worst-scoring category. However, it also has a number of other weaknesses. For example, the scope of the right is restricted to citizens and the law only applies to a limited set of public authorities. The law does not override competing provisions in other laws and key exceptions are not harm tested. While the law does provide for an appeal to an external oversight body, the oversight body cannot issue binding decisions and the grounds for appeal are limited.
